I am looking to rent out my property, do I need to carry out a Legionella Risk Assessment?
Yes - all landlords are now required to have a compliant legionella risk assessment undertaken. The health and safety legislation previously only applied to commercial premises however revised legislation (The Approved Code of Practice -ACOP L8) makes clear that the only way to be sure the Landlord is complying with the law is to carry out a risk assessment and then follow any resulting recommendations.
Legionnaires’ disease is a pneumonia like illness caused by the legionella bacteria. Legionella thrives in rivers, lakes and water systems. Hot water systems, especially where the temperature of the water is such as to encourage growth of the bacteria, are a considerable risk in residential properties. Legionella is also found in taps, showers, toilet cisterns, unused pipe work and hot and cold water tanks. The disease is caught by inhaling droplets of water that contain the bacteria such as water vapour from a contaminated shower head.
In addition to carrying out a Risk Assessment it is also considered best practice to ensure that your tenants are aware of the risks of Legionella and what they can do to minimise these risks. Make sure tenants keep shower heads and taps clean and, if they are not going to be using the water for an extended period of time, to run the taps for a few minutes before using the water. You should also make sure that you clean the taps thoroughly and descale showerheads between tenancies.
A legionella risk assessment must be carried out to identify potential risks and will propose any further action and remedial works that are needed. By following the ACOP L8 (Legionnaires’ disease and the Control of Legionella Bacteria in Water Systems) Code of Practice and having the risk assessment undertaken you will be protecting the health and safety of your tenants and ensuring you remain compliant with the law.
