What are the penalties for non-compliance with the new Minimum Energy Efficiency Standards?
A financial penalty of up to £5000 will be imposed for non-compliance with the Minimum Energy Efficiency Standards. If you provide false or misleading information to the PRS Exemptions Register then you can be awarded a penalty of £1,000, and if you fail to comply with a compliance notice can result in a fine of £2,000. If a landlord is found to be renting out a non-compliant property for a period of less than 3 months, the fine awarded will be £2,000, and if the non-compliant property has been rented out for a period of 3 months or more, the fine will be £4,000. In all cases the non-compliance will be published. The penalties are cumulative up to the maximum £5,000 per offence, and if the tenant changes or the regulatory backstop comes into effect, there is a possibility of further penalties.
